About these terms

By using kiwiandkoala.com or any of our games, you agree to these Terms of Use. These terms apply to all visitors and, where relevant, to purchasers of our licence. If you are a parent or guardian allowing a child to use our site, these terms also apply to you on their behalf.

These terms are governed by the laws of New Zealand.

Using the website and free games

Our free games are available to anyone at no cost. You may use them for personal, non-commercial educational purposes. You must not:

• Copy, reproduce, or redistribute any part of our games or website content
• Use our games for commercial purposes (e.g. in a school subscription service, tutoring business, or paid product) without our written permission
• Attempt to reverse engineer, decompile, or extract the source code of our games
• Use automated tools, bots, or scrapers to access our site

The licence key (paid access)

When you purchase full access, you receive a personal licence key that unlocks all games on our platform.

• One licence covers all devices within your household
• You must not share your licence key publicly or with people outside your household
• If we reasonably believe a licence key is being misused, we reserve the right to deactivate it
• New games added to the platform are included in your existing licence at no additional cost

Refund policy

Because our product is a digital licence key that is delivered immediately upon purchase, all sales are final and we do not offer refunds once a licence key has been issued.

We want every family to be happy with their purchase. If you experience any technical issue that prevents you from using your licence key, please contact us at hello@kiwiandkoala.com and we will do our best to resolve it promptly.

This refund policy does not affect any rights you may have under the New Zealand Consumer Guarantees Act 1993 or the Australian Consumer Law where those rights apply.

Payments

Purchases are processed securely through Payhip. We do not store your payment card details. By making a purchase you also agree to Payhip's terms of service. The price displayed at checkout is in NZD unless otherwise stated.

Intellectual property

All content on this website — including but not limited to game design, artwork, text, characters, and code — is owned by Kiwi & Koala or its licensors and is protected by copyright. Nothing in these terms grants you any ownership of our intellectual property.

The characters Kiki and Koko, and the Kiwi & Koala name and branding, are proprietary to us.

Curriculum alignment disclaimer

Kiwi & Koala games are designed to complement the New Zealand and Australian national curricula. We are not affiliated with, endorsed by, or connected to any government education body, the New Zealand Ministry of Education, or the Australian Curriculum, Assessment and Reporting Authority (ACARA).

Limitation of liability

Our games are provided for educational entertainment purposes. We make no guarantee that use of our games will result in any specific educational outcome. To the maximum extent permitted by law, Kiwi & Koala is not liable for any indirect, incidental, or consequential loss arising from your use of our website or games.

Nothing in these terms limits any rights you may have under the New Zealand Consumer Guarantees Act 1993 or Australian Consumer Law.

We may update these Terms of Use from time to time. When we do, we will update the "Last updated" date at the top of this page. Continued use of our website after changes are posted means you accept the updated terms.
